Non-O Visa Extension 

The Non-O Visa Extension is a request for a visa to continue staying in Thailand for foreign dependents who wish to accompany family members working or residing in Thailand. This applies to cases where families have business necessities or need to work in companies, among other reasons. The Non-O Visa Extension for dependents allows for a maximum stay extension of up to 1 year, subject to the discretion of Thai Immigration officials. While awaiting the decision on their application, applicants are permitted to remain in Thailand. It is important to note that the application for a Non-O Visa Extension must be submitted at least 21 days before the expiration of the current visa. 

Important Considerations When Applying for a Non-O Visa Extension 

  1. Timing: Ensure you submit your application at least 21 days before your current visa expires. 
  1. Documentation: Prepare all required documents carefully. Missing or incomplete documents can lead to delays or rejection. 
  1. Financial requirements: Be prepared to show proof of adequate funds to support your stay in Thailand. 
  1. Accuracy: Provide truthful and accurate information on all forms. False information can result in visa denial and potential legal consequences. 
  1. Overstay: Avoid overstaying your current visa while waiting for the extension approval. 
  1. Work restrictions: Remember that a Non-O Visa does not permit employment. Working without proper authorization can lead to severe penalties. 
  1. Address reporting: Be aware of the 90-day reporting requirement for long-term residents. 
  1. Visa conditions: Understand and comply with all conditions attached to your visa extension. 
  1. Changes in circumstances: Report any significant changes in your situation (e.g., divorce, change of address) to immigration authorities. 
  1. Renewal: Keep track of your visa expiration date and prepare for renewal well in advance 

Things you should know before applying for a Non-O Visa Extension 

  • For the first visa application, family dependents will receive a single-entry visa valid for 90 days, issued by the Royal Thai Embassy or Consulate-General in the country where the dependent holds citizenship. 
  • For subsequent visa extensions, family dependents can receive an extension for up to 1 year, subject to the discretion of the Immigration Bureau in Thailand. The extension application must be submitted at least 21 days before the current visa expires. During the consideration period, applicants can continue to stay in Thailand. 
  • Those granted a 1-year visa must report to the Immigration Bureau every 90 days. 
  • If it’s necessary to leave the country for any reason, a re-entry permit must be obtained from the nearest Immigration Office or at the international airport of departure. Without a re-entry permit, the visa may be canceled (except for Multiple Entry visas). 
  • Holders of dependent visas (Non-O) are not permitted to work in Thailand legally. If they wish to work, they must apply for a work visa (Non-B) and obtain a work permit. 
  • Dependents who are spouses must have both a legal and de facto relationship. 
  • Dependents who are children, adopted children, or stepchildren must be under 20 years old, still living with the family, and unmarried. 
  • Dependents who are parents must be at least 50 years old. 
  • In case of divorce, the dependent visa (Non-O) will be canceled, and the holder must leave Thailand immediately.
